Terms of Service
These terms govern your use of the BuilderGrid marketing website. Use of the BuilderGrid application is governed by your separate customer agreement.

1. Scope
These Terms of Service (the "Terms") apply to your access to and use of the BuilderGrid marketing website at buildergrid.io and any subdomains, pages, content, and forms published on it (collectively, the "Site"). Access to and use of the BuilderGrid application, customer portal, mobile applications, APIs, and related services (collectively, the "Application") is governed by a separate written agreement between BuilderGrid and the customer organization that subscribes to the Application. In the event of any conflict between these Terms and a customer agreement with respect to use of the Application, the customer agreement controls.
2. Acceptance
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
3. Permitted use
You may access the Site to learn about BuilderGrid, contact us, request a quote, and access publicly available content such as articles, calculators, and reference material. You may not use the Site to:
- Scrape, harvest, or systematically extract content for redistribution or model training without our prior written consent.
- Interfere with, probe, or attempt to compromise the security or availability of the Site or the systems behind it. Coordinated security research is welcome at [email protected].
- Misrepresent your identity or affiliation when contacting us through the Site.
- Use the Site or its content in a manner that violates applicable law or the rights of others.
4. Intellectual property
The Site, including its design, text, graphics, logos, calculators, articles, and underlying code, is owned by BuilderGrid or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site for your personal or internal business use. No other rights are granted by implication.
BuilderGrid, the BuilderGrid logo, and related names and marks are trademarks of BuilderGrid. Other marks displayed on the Site are the property of their respective owners and are used for identification purposes only.
5. Information you submit through the Site
When you submit information through a form on the Site, including the contact form, sales inquiries, support requests, and demo requests, you represent that the information is accurate and that you have the authority to provide it. You grant BuilderGrid a worldwide, royalty-free, non-exclusive license to use that information to respond to your inquiry, follow up with you, and operate and improve the Site. Information collected through the Site is handled in accordance with our Privacy Policy.
6. Data rights for customers and users of the Application
For clarity, and notwithstanding that the Application is governed by a separate customer agreement, you acknowledge and agree that BuilderGrid may collect, store, process, aggregate, anonymize, de-identify, and otherwise use data generated by or submitted to the Application, including data that you or your organization upload, for the following purposes:
- Providing, operating, securing, supporting, monitoring, and improving the Application and BuilderGrid’s other products and services.
- Internal analytics, product research and development, quality assurance, debugging, fraud and abuse prevention, and the development, training, evaluation, fine-tuning, and improvement of BuilderGrid’s own product features, including features that incorporate machine learning or other automated decision-making.
- Creating aggregated, anonymized, de-identified, and entity-level data products, including industry benchmarking, market intelligence, and similar offerings, which BuilderGrid may retain, license, sell, and otherwise commercialize without restriction.
BuilderGrid does not provide your data to third-party model providers for the purpose of training their foundation models or general-purpose AI systems, and does not sell personal information about individual users in a manner that constitutes a "sale" or "sharing" of personal information under applicable privacy law without providing the opt-out mechanism described in our Privacy Policy and at Do Not Sell or Share My Personal Information. The full scope of these rights, the limits on them, and the corresponding obligations on BuilderGrid are described in the customer agreement governing the Application and in the Privacy Policy.
7. Third-party links and content
The Site may link to third-party websites, services, or content. Those third parties are not under our control, and we are not responsible for their content, policies, or practices. Your use of any third-party site or service is subject to that party’s terms.
8. No warranty
The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BuilderGrid disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Information published on the Site, including articles, calculators, and reference material, is provided for general informational purposes and does not constitute legal, financial, accounting, or professional advice.
9. Limitation of liability
To the fullest extent permitted by law, BuilderGrid and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site, including loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to your use of the Site will not exceed one hundred United States dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the foregoing limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless BuilderGrid and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your misuse of the Site, or your violation of applicable law or the rights of any third party.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. The provisions of these Terms that by their nature should survive termination will survive, including provisions on intellectual property, data rights, no warranty, limitation of liability, indemnification, and governing law.
12. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
13. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and BuilderGrid with respect to the Site. Use of the Application is governed by the applicable customer agreement, which prevails over these Terms with respect to the Application.
